3. Arrest - With and Without Warrant 🔒

Arrest is the taking of a person into custody in order that he may be bound to answer for the commission of an offense.

📝 ARREST WITH WARRANT (Rule 113, Sec. 5)

Requirements for Valid Warrant:

  • • Issued by a judge upon probable cause
  • • Personal examination of complainant and witnesses
  • • Particularly describes person to be arrested
  • • May be served any day, any time

⚡ WARRANTLESS ARREST (Rule 113, Sec. 5)

Allowed ONLY in these instances:

1. IN FLAGRANTE DELICTO

Person is actually committing, attempting, or has just committed offense in officer's presence

2. HOT PURSUIT

Offense just committed + probable cause based on personal knowledge that person committed it

3. ESCAPED PRISONER

Escaping from penal establishment or while being transferred

⚖️ Miranda Rights (RA 7438)

Must be informed of rights BEFORE custodial investigation:

  • • Right to remain silent
  • • Right to have competent and independent counsel (preferably of own choice)
  • • Right to be informed of these rights
  • • Waiver must be in writing AND in presence of counsel

⚠️ Exclusionary Rule: Evidence obtained through illegal search is INADMISSIBLE ("fruit of the poisonous tree"). However, this rule does NOT apply to private individuals - only to state agents.
