1. RA 4136: The Land Transportation and Traffic Code 📜

Republic Act 4136 ay ang MAIN LAW na nag-govern ng lahat ng land transportation sa Philippines. Ito ang foundation ng lahat ng driving laws.

3. RA 10586: Drunk Driving Law 🍺

Driving Under the Influence (DUI) - The Law

Definition: Driving while impaired by alcohol, drugs, or any substance affecting ability to drive safely.

Blood Alcohol Content (BAC) Limits:

  • 0.00% BAC = Zero tolerance in some cases
  • 0.05% = Professional drivers (stricter)
  • 0.10% = Maximum for ordinary drivers

Testing Methods: Breathalyzer test, blood test, sobriety test

Penalties for DUI:

  • First offense: ₱10,000-₱50,000 fine + 1-12 months imprisonment
  • License suspension: Minimum 6 months
  • Second offense: ₱50,000-₱100,000 + jail time, 1-year license suspension
  • Third offense: ₱100,000+ + permanent license revocation

5. Motor Vehicle Liability Insurance 🛡️

Mandatory Insurance Coverage

Required by Law: All vehicles on public roads MUST have valid Motor Vehicle Liability Insurance (MVLI).

Coverage:

  • Third-party liability (injury/death to other people)
  • Third-party property damage
  • Minimum amount: ₱50,000 (for motorcycles), ₱100,000-₱500,000+ (for vehicles)

Penalty for No Insurance: ₱5,000-₱10,000 fine, license suspension, vehicle impounding

6. Other Important Laws & Regulations 📋

RA 8750: Helmet Law

Motorcyclists & passengers MUST wear approved helmets. Penalty: ₱500-₱1,000. No helmet = road crash risk!

RA 10930: Seatbelt Law

All passengers (front & back) MUST wear seatbelts. Drivers responsible. Penalty: ₱250-₱1,000 per person

Child Restraint Laws

Children under 10 years or below 4.5 ft height MUST use appropriate child safety seats/boosters. Driver liable for violations.

Mobile Phone Restrictions

Using phones while driving (texting, calls, scrolling) is ILLEGAL. Penalty: ₱250-₱1,000. Safety hazard - causes accidents!

Number Coding/Driving Restrictions

Some cities have number coding restrictions (certain vehicles banned on specific days). Check local ordinances. Penalty varies by city.

7. Demerit Point System 🎯

How Demerit Points Work

Traffic violations accumulate demerit points. Accumulation = license suspension.

  • Points Per Violation: 2-10 points depending on violation severity
  • Speeding: 2-4 points (depending on how much over limit)
  • Reckless Driving: 8-10 points
  • Accumulation: 15+ points = license suspension review/possible suspension
  • Point Reduction: Safe driving for 1 year = points reduced
